Hi Folks - just looking for sage advice/favors (again)

Thing 1.
Is there anywhere to get a copy of the Green Converse book, or access to its contents? 

Thing 2. 
I'd like to have a close look at the version of "Jersey Lightning" that's in the Dan Emmett manuscript. Can anyone help me out with this?

Thing 1. I have one coming from LOC. It needed restoration before they could copy it, but one is on the way. This will give me the rights to it, so I would be glad to share at that point. I'm sure you might find somebody offline that would copy and send it. It is just not avalable from Tuckahoe, and does not look like it ever will be again. They are simply sold out from any conventional retail outlet. I almost feel like just copying mine from Tuckahoe, but an ethical thread runs through my bones...online. I will certainly put it up on the Clubhouse site when I get it.

I can wait - Heaven knows, if I learned all the tunes in the books I already have I'd be set for the rest of my life and then some!
I'm currently busy looking up all the tunes I liked and tried to pick up by ear on the weekend, before I forget them all - or even which ones they were.
I have no problem with sending you a few. Let me know.

Searching for answers on this subject on the US copyright office, I ran across "Circular 14."

Because he has decided not to make any more of these available, I fully intend to scan my copy into PDF, sans his "newly copyrighted material" and post it. He has zero claim to copyright PD works...

But don't take my word for it, read for yourself...

I would still question this. Although your making this available is doing the community a great service, I don't think you can simply scan his book to do this. Read the acknowledgments in the beginning...standard jargon for not reproducing. But what does that mean...we all play it and record it and copy it in part. I am all for somebody making a profit on this if they go through the effort of making it available, and useable. This is not the case with Tuckahoe anymore, as you just can't get it anywhere. You are right in that nobody can claim PD works, but his reproduced version is protected. But, if you scanned it, how could one tell the source? (I have found that originals have small print changes when published in Tuckahoe.) Although, you may be able to secure a copy from LOC, you would be free to do so if you had permissions from LOC.

Bottom line, this stuff needs to get out there...perhaps you gotta go underground, like the Real Book in the jazz community. It was "just understood" that it is available...under the counter. I'm all for that...it worked for jazz. For what it's worth, Hal Leonard now has a "Real Book" for sale. Ah, the magic is gone from that clandestine moment.
When I get mine, I will put it up on the Clubhouse Site.
It is not protected, read the attached circler 14 from the copyright office.

"The copyright in a derivative work covers only the additions,
changes, or other new material appearing for the first time in
the work. It does not extend to any preexisting material and
does not imply a copyright in that material.

One cannot extend the length of protection for a copyrighted
work by creating a derivative work. A work that has
fallen into the public domain, that is, a work that is no longer
protected by copyright, can be used for a derivative work,
but the copyright in the derivative work will not restore the
copyright of the public-domain material. Neither will it prevent
anyone else from using the same public-domain work
for another derivative work."
Let me add that his additions are the only protected part, by simply omitting that , the images are no different than what you have. I would not reproduce his introduction or the back cover.
